Supreme Court Rejects Gujarat Government’s Plea for Review in Bilkis Bano Case

New Delhi, September 27 – In a significant development, the Supreme Court of India dismissed a review petition filed by the Gujarat government, challenging its earlier judgment related to the release of 11 convicts in the Bilkis Bano case. The court’s decision has reaffirmed its stance on the matter, which had garnered widespread public attention due to the sensitive nature of the case.

A bench comprising Justices B.V. Nagarathna and Ujjal Bhuyan delivered the ruling on Thursday, stating that there was “no error apparent on the face of the record” and that the review petition lacked merit. The judges expressed satisfaction with the original verdict and found no compelling reason to reconsider or alter their previous decision.

“Having carefully gone through the Review Petition, the order under challenge, and the supporting documents, we are satisfied that there is no error apparent on the face of the record or any merit in the Review Petition, warranting reconsideration of the order impugned. The Review Petition is, accordingly, dismissed,” the bench observed in its order.

Gujarat’s Plea to Overturn Adverse Observations Denied

The Gujarat government had sought a review of the Supreme Court’s January 8 verdict, where the court had struck down the state’s decision to grant remission to the convicts. The government’s plea argued that the apex court’s critical remarks—specifically accusing the state of “usurpation of power” and “abuse of discretion”—were based on an apparent error in the original judgment.

However, the court remained firm in its decision, rejecting both the plea for review and the Gujarat government’s application for an open-court hearing. The rejection signifies that the adverse observations made in the January 8 judgment will stand, and the state’s actions will continue to be seen as an overreach of power.

The Gujarat government, in its review petition, contended that no adverse inference should be drawn against it for not filing a review petition earlier, referencing a coordinate bench’s judgment dated May 13, 2022. Yet, the Supreme Court maintained that Gujarat had exceeded its jurisdiction when it granted remission to the convicts.

Background of the Bilkis Bano Case

The Bilkis Bano case is a harrowing chapter from the 2002 Gujarat riots, which erupted following the Godhra train-burning incident. Bilkis Bano, who was five months pregnant at the time, was gang-raped while she and her family were attempting to flee the communal violence. Along with the assault on Bilkis, seven of her family members, including her three-year-old daughter, were brutally killed during the riots. In August 2022, the Gujarat government granted remission to all 11 convicts involved in the case, leading to their release on Independence Day. Supreme Court’s January 8 Ruling

On January 8, 2024, the Supreme Court quashed the remission orders granted by the Gujarat government, declaring that the state had no jurisdiction to offer such relief. The bench pointed out that since the crime had taken place in Maharashtra, the power to grant remission rested with the Maharashtra government, not Gujarat.

The court harshly criticised the state of Gujarat for “usurping” the authority of Maharashtra, terming the remission a violation of the rule of law. “This is a classic case where the order of this court dated May 13, 2022, has been used for violating the rule of law while passing orders of remission in favour of respondent nos. 3 to 13 (convicts) in the absence of any jurisdiction by the state of Gujarat,” the court had noted in its judgment.

The apex court further ordered that the convicts be sent back to jail within two weeks, striking down the orders of remission as unlawful. The dismissal of Gujarat’s review petition on Thursday reinforces this judgment, ensuring that the convicts’ release remains overturned.

New Delhi, September 26, 2024:- In a recent advisory, the Indian government has directed all States and Union Territories (UTs) to take immediate and strict measures to control the spread of Mpox, formerly known as monkeypox. Health Secretary Apurva Chandra emphasized the importance of public health interventions to prevent further outbreaks across the nation.

The advisory highlighted the need for increased public awareness about Mpox, particularly focusing on how the virus is transmitted and its key symptoms. States and UTs have been encouraged to engage local communities and stress the significance of early detection and reporting. “All states and UTs are requested to take appropriate steps to inform communities about the disease and its prevention,” the advisory stated.

Key Guidelines for Controlling Mpox:

  1. Public Awareness Campaigns: States and UTs are instructed to initiate community outreach programs to educate the public on Mpox symptoms, transmission, and the importance of timely reporting.
  2. Isolation of Suspected Cases: Any suspected Mpox cases must be isolated immediately, and stringent infection control protocols must be followed.
  3. Adequate Isolation Facilities: Hospitals are advised to ensure they have the capacity to isolate both suspected and confirmed Mpox cases, with trained medical personnel and proper logistical support.
  4. Symptomatic Treatment: The Health Ministry urged all hospitals to follow current treatment protocols, focusing on symptomatic management of Mpox patients.
  5. Sample Testing: States must send samples from suspected cases to designated laboratories for confirmation. Positive cases should be forwarded to ICMR-NIV for genome sequencing to identify the Mpox strain.
  6. Enhanced Diagnostic Capabilities: The advisory recommended using ICMR-approved laboratories and PCR kits to detect the virus early and initiate containment measures.
  7. Monitoring Health Infrastructure: Senior health officials at both the state and district levels were encouraged to regularly evaluate the public health infrastructure and preparedness for handling Mpox cases.

What to Avoid:

The Health Ministry also outlined several critical don’ts to minimize Mpox transmission:

  1. Avoid Panic: States are urged to communicate effectively with the public to prevent unnecessary panic while clearly explaining preventive measures.
  2. No Delays in Reporting: Prompt reporting of suspected cases is essential. Any delays could lead to further transmission and exacerbate the situation.
  3. Avoid Overcrowding Healthcare Facilities: Only symptomatic or confirmed cases requiring isolation should be admitted to healthcare facilities to prevent overburdening the system.
  4. Do Not Ignore Mild Cases: Even mild cases should be tested and isolated if necessary to ensure the virus doesn’t spread undetected.

The advisory underscores the importance of coordinated efforts between states, UTs, and healthcare facilities to control the spread of Mpox and safeguard public health across India.

The Commencement Day event featured Shri N Uttam Kumar Reddy, Minister for Irrigation, Consumer Affairs, Food, and Civil Supplies, Government of Telangana, as the Chief Guest. MJCET’s racing team, led by captain Mohammed Jawad Ahmed and vice-captains Mohammed Rayhan Khaleel, along with pilots Doula Shaikh and Muzaffar Ahmed, will compete against 60 shortlisted teams from across the nation, including top institutions like NITs and IITs.

The vehicle, powered by a 400cc Dominar engine with a torque of 35 Nm, boasts a top speed of 120 km/h and weighs around 210 kg. The vehicle will undergo rigorous technical inspections before participating in both static and dynamic events, culminating in the endurance race. The project was completed under the guidance of Dr. Mohammed Viquar Mohiuddin, Professor & Head of the Mechanical Engineering Department, and coordinated by Mr. Ahmed Abdul Muneem, Assistant Professor, with sponsorship from the Sultan-ul-Uloom Educational Society.

The vehicle was flagged off by Shri N Uttam Kumar Reddy, along with Zafar Javeed and other SUES dignitaries during the Commencement Day ceremony. The Minister and dignitaries expressed their best wishes to the team for the upcoming competition.

Hyderabad: In a significant move to bolster the healthcare workforce, the Medical and Health Services Recruitment Board has officially notified the recruitment of 633 Pharmacist Grade 2 positions across various departments of the Telangana Health Department. The announcement was made on Tuesday, September 24.

The breakdown of vacancies reveals that 446 positions are available under the Director of Public Health and Family Welfare, while 185 vacancies are allocated to the Telangana Vaidya Vidhana Parishad. Additionally, there are 2 openings at the MNJ Institute of Oncology and Regional Cancer Centre.

Interested candidates can submit their online applications starting October 5, with the final date for submissions set for October 21 at 5 PM. Applicants will also have the opportunity to edit their applications from 10:30 AM on October 23 until 5 PM on October 24.

Government Sanctions 15,000 2BHK Homes for Musi Riverfront Project-Affected Families

Hyderabad: In a major step following the Chief Minister Revanth Reddy’s announcement, the Telangana State government has sanctioned 15,000 double-bedroom homes (2BHK) for families affected by the Musi Riverfront Development Project. The announcement, made on Wednesday, will benefit those living in the riverbed and buffer zones of the Musi River.

The Musi River Front Development Corporation Limited (MRFDCL) conducted a detailed field survey, identifying around 15,000 households residing in the area. Given the economic vulnerability of these families, the MRFDCL requested the government to allocate 2BHK units in the Greater Hyderabad Municipal Corporation (GHMC) region. The District Collector will oversee the allocation process on humanitarian grounds.

The survey revealed that approximately 10,200 residents have been directly affected by the project. The state government will begin the relocation process, starting with 1,600 homes currently occupied within the riverbed area. Teams led by the collectors of Hyderabad, Rangareddy, and Medchal-Malkajgiri districts will visit affected families to inform them about their new housing allotments.

For landowners within the project zone, the compensation will cover both the value of the land and the construction, along with the allotment of a 2BHK home. Those residing in the buffer zone will be compensated for their structures in accordance with the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation, and Resettlement Act.

The relocation is set to begin immediately, marking a significant development in the Musi Riverfront project and offering relief to thousands of affected families in Hyderabad.

Keonjhar (Odisha), Sep 25: In a heart-wrenching incident from Keonjhar district, Odisha, an 80-year-old woman was forced to crawl nearly two kilometers from her home to the local panchayat office to collect her old-age pension. The elderly woman, identified as Pathuri Dehury, a resident of Raisuan gram panchayat, is unable to walk due to her age and health issues.

A video showing Dehury crawling on a village road has gone viral, drawing widespread attention on social media. The distressing scene has sparked outrage over the plight of the elderly in rural areas.

Local authorities, including Raisuan gram panchayat sarpanch Bagun Champia, responded after seeing the incident featured on television news and in newspapers. Champia confirmed that he had verified with local villagers that Dehury’s inability to walk is due to her advanced age and related ailments.

Although the Odisha government had previously directed officials to deliver pensions directly to the homes of elderly and disabled beneficiaries, Dehury said that a panchayat official asked her to come to the office to collect her pension. With no other option, she embarked on the arduous journey.

Telkoi Block Development Officer (BDO) Geeta Murmu stated that Dehury’s pension had previously been sent directly to her bank account. However, as her condition worsened and she could no longer visit the bank, local authorities began delivering the pension by hand. Murmu added that the panchayat extension officer has now been instructed to disburse the pension at Dehury’s home each month, and a wheelchair has been provided to her.

In addition, the civil supply assistant will now deliver ration supplies to Dehury’s doorstep, ensuring she receives the essentials without the need to leave her home.

The state government currently provides pensions to over 42 lakh elderly people under schemes such as the Madhu Babu Pension Yojana and the Indira Gandhi National Old Age Pension Scheme.

This is not the first time such an incident has occurred in Odisha. Earlier, a video surfaced showing another elderly woman from Odisha using a plastic chair as a walker to collect her pension. The video caught the attention of Finance Minister Nirmala Sitharaman, who tweeted about the incident, urging officials to show some compassion and ensure that pensions are delivered to the homes of the elderly.

In January of this year, a similar case was reported from Karnataka, where 77-year-old Girjamma was filmed crawling on the ground to collect her pension. These incidents highlight the continued challenges faced by elderly citizens in accessing basic entitlements like pensions, despite directives and government programs aimed at assisting them.

This digital family card will enable citizens to access medical care, subsidized food grains, and welfare scheme benefits across the state.

The government plans to introduce the card through a pilot project in selected urban and rural areas in every Assembly constituency, ensuring a broad testing base before statewide implementation.

Hyderabad, September 24, 2024 — BRS working president KT Rama Rao launched a fierce critique against Chief Minister Revanth Reddy and his brother A Tirupathi Reddy, accusing them of destroying the lives of the underprivileged through HYDRA operations. KTR condemned the Congress government for its ruthless demolition of homes and businesses of the poor without offering adequate support or time for relocation.

Speaking at a party workers’ meeting in Serilingampally on Tuesday, KTR highlighted the disparity in the treatment of the poor versus the elite. “Under HYDRA, the poor are being thrown onto the streets. Meanwhile, Tirupati Reddy received a notice, allowing him to approach the court and secure a stay order protecting his properties. Is there one law for the poor and another for the Chief Minister’s family?” he questioned.

KTR accused Revanth Reddy’s family of exploiting the State and targeting vulnerable communities. He pointed out that Serilingampally MLA Arekapudi Gandhi had previously alleged that Tirupati Reddy was running a “commission shop” in Madhapur, profiting from the state’s resources. Confident about the upcoming political scenario, KTR asserted, “A by-election in Serilingampally is imminent, and the BRS will emerge victorious.”

Challenging Congress’s Policies

KTR did not hold back in challenging the Congress government’s actions, particularly in demolishing structures deemed illegal. He accused the current administration of trying to shift blame for illegal constructions approved by previous Congress governments. “You allowed these constructions, and now you are demolishing them, leaving the poor homeless. Take responsibility for your past actions,” he demanded.

He contrasted the Congress’s “politics of destruction” with the BRS government’s focus on development. KTR listed BRS’s accomplishments, including the construction of double-bedroom houses, flyovers, and sewage treatment plants (STPs).
