Former DCP Sent to 7-Day Police Custody in Telangana Phone Tapping Case

0

In a significant development, a Hyderabad court on Wednesday granted a seven-day police custody for Radha Kishan Rao, former Deputy Commissioner of Police, Task Force, in connection with the Telangana phone tapping case.

The decision came after the Nampally court heard the police petition, scheduling Rao’s custody from April 4 to April 10.

Rao, identified as the fourth accused in the case, which surfaced last month, has stirred political circles. Following his retirement, he served as an Officer on Special Duty (OSD) in the Task Force before his arrest on March 28. The subsequent day, the Nampally court remanded him to judicial custody for 14 days.

Allegations have surfaced suggesting the formation of a Special Operations Team within the Special Intelligence Branch (SIB) for monitoring rival political leaders, their families, and dissenters within the ruling party.

Former SIB chief Prabhakar Rao, reportedly close to the previous Chief Minister K. Chandrasekhar Rao, is said to have orchestrated the formation of the SOT alongside DSP D. Praneeth Rao, the first police officer arrested in the case last month.

Reports suggest that based on Praneeth’s inputs, the Task Force intercepted large sums of money during various elections, including Rs 70 lakh from Anand Prasad, the TDP candidate from Serilingampally constituency during the December 2018 elections.

Furthermore, during the 2020 Dubbaka by-election, Rs 1 crore was seized based on the SOT’s information, linked to a chit fund company in Siddipet with connections to BJP candidate M. Raghunandan Rao.

Similarly, during the Munugode by-election in October 2022, Rs.3.5 crore belonging to BJP candidate Komatireddy Raja Gopal Reddy was intercepted and seized.

Two other police officers, N. Bhujanga Rao and M. Tirupatanna, who served in SIB, were sent to judicial custody until April 6 after their five-day police custody ended on Tuesday. The officers were arrested on March 23.

Meanwhile, Prabhakar Rao, the former SIB chief, has resigned from his position following the change in government. Police have issued a lookout notice for him as he is believed to be abroad.

ED Initiates Money Laundering Case Against Mahua Moitra and Darshan Hiranandani

0

The Enforcement Directorate (ED) has launched a money laundering investigation against Trinamool Congress (TMC) leader Mahua Moitra and businessman Darshan Hiranandani. The probe is linked to an alleged cash-for-queries scam, according to official sources on Tuesday.

The federal agency initiated the enforcement case information report (ECIR), which is equivalent to a police FIR, based on a complaint filed by the Central Bureau of Investigation (CBI), the sources said.

The ED registered the case two to three days ago and has been investigating Moitra and Hiranandani under the civil sections of the Foreign Exchange Management Act (FEMA). Both individuals have been called in for questioning, but have not appeared yet, citing official commitments.

Last month, the CBI conducted searches at Moitra’s premises after filing its FIR. Moitra, a former TMC MP from the Krishnanagar seat in West Bengal, has been renominated by the TMC to contest in the upcoming Lok Sabha elections.

The CBI registered an FIR against Moitra and Hiranandani following the Lokpal’s directions, instructing the agency to submit its report within six months. In December 2023, Moitra was expelled from the Lok Sabha for “unethical conduct,” a decision she has challenged in the Supreme Court.

The Lokpal directed the CBI to investigate allegations made by Bharatiya Janata Party (BJP) Lok Sabha member Nishikant Dubey against Moitra. Dubey alleged that Moitra had accepted cash and gifts from Hiranandani in exchange for asking questions in the Lok Sabha to criticize industrialist Gautam Adani and Prime Minister Narendra Modi, among others.

The FIR, registered on March 21, charges Moitra and Hiranandani with “criminal conspiracy, offences related to public servant being bribed, offence relating to bribing of a public servant, and abetment.”

‘Be Ready For Action’: Supreme Court Warns Ramdev and Patanjali MD in Misleading Ads Case

Yoga Guru Ramdev and the managing director of Patanjali Ayurved, Acharya Balkrishna, found themselves in hot water on Tuesday as they tendered an “unconditional apology” before the Supreme Court. This apology was in response to their failure to file proper compliance affidavits in a case related to misleading advertisements, with the court admonishing them for breaking “every barrier”.

The Supreme Court did not mince words, telling Ramdev and Balkrishna to “be ready for action”. It also expressed disapproval of Balkrishna’s statement calling the Drugs and Cosmetics (Magic Remedies) Act archaic. The court’s displeasure was evident when it rejected Patanjali’s apology tendered last month, stating, “We are not happy with your apology”.

A bench comprising Justices Hima Kohli and Ahsanuddin Amanullah emphasized that every court order in the country must be respected. They criticized the duo for their defiance, stating, “You have to abide by the undertaking given to the court, and you have broken every barrier”.

The court questioned why the Centre had turned a blind eye when Patanjali was claiming there were no remedies for Covid in allopathy. Senior advocate Balbir Singh, representing Ramdev, urged the court to consider Ramdev’s presence and unconditional apology. Solicitor General Tushar Mehta expressed regret over the incident, stating, “What has happened should not have happened”.

Justice Kohli reminded Balkrishna’s counsel that they should have ensured the filing of the compliance affidavits as per their undertakings. The bench granted a final opportunity to Ramdev and Balkrishna to file their affidavits within one week. The matter is scheduled for further hearing on April 10, with the directive that both of them must be present before the court on that date.

The apex court had directed Ramdev and Balkrishna to appear before it on March 19 after taking exception to Patanjali’s failure to respond to a notice issued in the case regarding the advertisements of the firm’s products and their medicinal efficacy.

“AAP’s Sanjay Singh Granted Bail after six months in Delhi Excise Policy Case”

Watch the Supreme Court Proceedings on Sanjay Singh’s Bail

Aam Aadmi Party leader Sanjay Singh was granted bail by the Supreme Court on Tuesday, marking the end of his six-month detention in the Delhi Excise Policy case. The court’s decision came with a directive for Singh’s release on terms set by the trial court, emphasizing that this ruling doesn’t set a precedent. Notably, Singh is permitted to resume his political engagements.

During the proceedings, the Supreme Court questioned the Enforcement Directorate about the necessity of further custody for Sanjay Singh, highlighting his prolonged detention. The bench sought clarification on whether Singh’s continued custody was warranted. Singh had been arrested last year by the ED in connection with the Delhi excise policy scam case.

The apex court entertained Singh’s plea challenging his arrest and remand in the money laundering case. It observed that no money was found in Singh’s possession and suggested that allegations of bribery could be scrutinized during the trial. Additional Solicitor General S V Raju, representing the ED, assured to address Singh’s arguments against his arrest and remand.

Singh’s bail plea had earlier been contested by the probe agency in the high court, alleging his involvement in various aspects of the liquor scam. The ED claimed that Singh had benefited from illegal proceeds and played a part in the conspiracy surrounding the Delhi Excise Policy 2021-22.

The ED’s money laundering case, stemming from a CBI FIR, focuses on irregularities in the modification of the now-defunct Delhi Excise Policy 2021-22. Both agencies assert that undue advantages were granted to license holders, leading to the initiation of legal proceedings against Singh and others involved in the alleged misconduct.

“SC Takes Notice of Plea to Enhance Transparency in Election Process Regarding EVMs”

0

In response to a petition urging for greater scrutiny of Electronic Voting Machines (EVMs), the Supreme Court of India has directed its attention towards the Election Commission of India (ECI). The petition advocates for a comprehensive tallying of Voter-Verifiable Paper Audit Trail (VVPAT) slips in elections.

Currently, VVPAT verification involves only a random selection of five EVMs per assembly segment. However, the petitioner insists on scrutinizing every EVM vote against its corresponding VVPAT slip, advocating for a more robust validation process.

Furthermore, the petitioner seeks to enable voters to physically deposit their VVPAT slips in a ballot box, ensuring their ballots are accurately accounted for.

A bench comprising Justice BR Gavai and Justice Sandeep Mehta has issued notice to the ECI, tagging the plea with other related matters concerning EVMs and VVPATs.

The petition, filed by lawyer and activist Arun Kumar Agrawal, challenges the ECI’s guideline of sequential VVPAT verification, arguing that simultaneous verification would expedite the process without compromising accuracy.

The plea highlights discrepancies between EVM and VVPAT counts in the past and emphasizes the importance of meticulous VVPAT verification, considering the significant investment in VVPATs by the government.

This development comes against the backdrop of previous petitions and court interventions regarding VVPAT verification processes. While the Supreme Court had previously increased the number of EVMs subjected to VVPAT verification from one to five, concerns persist regarding the adequacy of the verification process.

The Court’s scrutiny of election processes underscores the importance of transparency and integrity in the democratic process, as it continues to deliberate on matters of public interest concerning electoral procedures.
