Hyderabad Court Grants Anticipatory Bail to Ex-Cricket Captain and Congress Leader Azharuddin

Hyderabad : In a recent development, a Hyderabad court extended anticipatory bail to former Indian cricket captain and Congress leader, Mohammed Azharuddin. This legal respite pertains to four cases alleging the misappropriation of funds from the Hyderabad Cricket Association (HCA) during Azharuddin’s tenure as its president until earlier this year.

The court has prohibited the Rachakonda police from arresting Azharuddin, instructing them to serve a notice under Section 41A of the CrPC for questioning instead.

This decision brings relief to Azharuddin, who not only served as an MP but also holds the position of working president in the Telangana Pradesh Congress Committee. Furthermore, he is currently contesting as the Congress candidate in the Jubilee Hills Assembly constituency.

The allegations against Azharuddin and others stem from last month when four criminal cases were registered, accusing them of misappropriating approximately Rs 3.85 crore. The cases were lodged at Uppal Police Station, falling under the Rachakonda Police Commissionerate’s jurisdiction.

The funds, originally intended for the purchase of cricket balls, gym equipment, fire safety equipment, and chairs at the Rajiv Gandhi International Cricket Stadium in Uppal, were allegedly misused. These cases were initiated based on a complaint filed by HCA CEO Suneel Kante Bose.

The charges against Azharuddin and his associates include criminal breach of trust, cheating, forgery, and criminal conspiracy. The former cricketer vehemently denied these allegations, dismissing them as false and motivated.

Azharuddin expressed his stance on the matter, stating, “I want to state that these are all false & motivated allegations & I am in no way connected with the allegations. I will reply to the motivated allegations against me at an appropriate time. This is just a stunt pulled by my rivals to ruin my reputation. We shall stay strong and fight harder.” This statement was posted on ‘X’.

In a significant development, the Hyderabad police apprehended notorious rowdy sheeter Hamza bin Omer, known as Zafar Pahelwan, on Monday. He was taken into custody due to his alleged involvement in a recent case reported at the Saifabad police station just last month.

The incident in question unfolded during a wrestling tournament held at LB Stadium, where two rival groups clashed. One faction was led by Zafar Pahelwan, while the other was under the leadership of Salem Pahelwan. The confrontation erupted following a dispute during the tournament.

Based on a formal complaint filed by Salem, the police registered a case against Zafar Pahelwan and his associates, accusing them of causing grievous injuries and criminal intimidation. These charges fall under sections 325, 324, and 506 of the Indian Penal Code (IPC).

Acting swiftly, the Saifabad police, with assistance from the commissioner’s task force team, took Zafar Pahelwan into custody. This occurred while he was attending a funeral at Azampura. He was served a notice under section 41A of the Criminal Procedure Code (CrPC) in connection with the case. Additionally, the police bound him over for good conduct and issued a stern warning against engaging in unlawful activities, particularly in light of the upcoming elections.

It’s worth noting that Zafar Pahelwan’s history-sheet at the Rein Bazaar police station dates back to 1982. He previously served as a constable at CPL Amberpet but was subsequently dismissed from the service due to his involvement in criminal activities.

The High Court has issued a stay on the summons that were earlier served by a Delhi court to Sunita Kejriwal. The summons had been issued on the grounds of her alleged possession of two voter identification cards. Justice Amit Bansal has temporarily stayed these summons until February 1, 2024. The legal notice had stemmed from a complaint filed by Delhi BJP leader Harish Khurana on August 29, 2023.

Khurana’s complaint alleged that Sunita Kejriwal was registered to vote in two separate constituencies: Sahibabad, Uttar Pradesh, and Chandni Chowk, Delhi. He argued that this dual registration violated the Representation of the People Act. Following a preliminary review of the allegations and supporting evidence, the Metropolitan Magistrate at Tis Hazari Court summoned Sunita Kejriwal, stating that a prima facie case existed against her.

Sunita was initially required to appear in court on November 18, 2023. However, she opted to challenge the summons in the High Court. Representing Sunita, senior lawyer Rebecca John argued that an offense under the Representation of the People Act is only applicable when an individual submits a false affidavit. In this case, Khurana failed to provide substantial evidence to support the claim of a fraudulent declaration.
